Tornado touches down in New York City

During heavy rainstorms that flooded rail lines and subways, a tornado touched down in New York City, the National Weather Service reports. It sustained winds around 111 mph to 135 mph, causing damage to buildings and vehicles. Starting from the Bay Ridge area, the tornado continued for two miles through Brooklyn. At least one person was killed.

The roof of a Nissan dealership had been ripped off, as was that of a Brooklyn church. At least 16 homes were damaged.

Torrential rain had drenched the region early Wednesday, causing delays at Newark, JFK, and LaGuardia airports. Wind and rain caused major slowdowns in the mass transit lines, virtually halting services. The brunt of the storm struck the city during morning rush hour, a time when hundreds of thousands of vehicles and people are in transit to work. Police Commissioner Raymond Kelly said that in some flooded subways, police resorted to crowd control tactics to stop rioting.

Trees were torn from the ground and some cars were crushed.

In a damage assessment tour of Brooklyn, Mayor Michael Bloomberg remarked, “I don’t know that God had rush hour in mind when the storms hit.”

The Metropolitan Transit Authority expects service to return to normal by Thursday. At a press conference MTA chairman Elliot “Lee” Sander said the pumps located citywide in the rail and subway lines are adequate to handle 1.5 inches of rain per hour. He said the rain, however, came “too fast and with little warning.”

“The storm took us by surprise because it was not predicted by the National Weather Service.”

Buffalo, New York —A proposed hotel that was supposed to be built at the corner of Elmwood and Forest Avenues in Buffalo, New York is apparently off the table. The former proposal was going to be called The Elmwood Village Hotel and would have consisted of 72 rooms and cost between $7 to $10 million American dollars to build.

Today several unknown individuals were seen removing a sign that was dedicated to the “Elmwood Village Gateway,” which signifies the beginning of the Elmwood Village at the formerly proposed project’s location.

Nearly an hour later the men replaced the sign with a different and unexpected sign: “For Sale: 5 commercial parcels and 1 carriage house, By: Owner.” Those 5 “parcels” are 1109-1121 Elmwood and 999 Forest Avenue, which is located in an illegal alley, according to the City of Buffalo, behind the 5 other properties on Elmwood. Hans Mobius owns all properties named in the sale.

Sam Savarino, CEO of Savarino Companies never owned the properties and has repeatadly told Wikinews in exclusive interviews that he still had a “contract to buy the properties” and on October 2, 2006 told Wikinews in an exclusive interview that he “extended” the “agreement to purchase the property[s] and will have it under contract for what we hope is a sufficient period of time.”

“He [Mobius] is undoubtedly concerned because he has lost some tenants and is a bit impatient. I think he has properly portrayed the situation,” said Savarino in an exclusive interview with Wikinews.

Savarino also says that there may be “legal issues” to work out now, before anything else can move forward, regarding the proposal.

“There are some legal complexities that must be sorted out before anything can happen there,” added Savarino.

The welcome sign was; however, not removed entirely. The sign was placed, facing the same direction of north, on the side of the Forest Plaza Art Gallery, a new art gallery located on the corner of Forest and Elmwood.

Nancy Pollina, owner of Don Apparel which was located at 1109 Elmwood, but closed on October 14, 2006 considers this a possible “victory” in regards to the lawsuit filed against the hotel to stop it from being built, alleging that several laws were broken, including not performing an Environmental Impact Study before the proposal was approved by the city, during its approval and the proposal was “rushed.” Patricia Morris, who operates Don Apparel with Pollina, Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway, were also plaintiffs in the lawsuit. They filed the suit with a lawyer representing them, Arthur J. Giacalone, on April 25, 2006 in New York State Supreme Court, but the case has never gone to a courtroom.

Giacalone believes that a press release issued in July regarding the project was nothing but a statement to “save face,” but that the placement of the for sale sign might be a way of convincing Savarino to speed up the sale of the properties.

“I thought all along that Savarino’s July press release might be no more than an effort to save face. But we have no way of knowing. Similarly, Mobius might have put the for-sale sign up in an attempt to pressure Savarino into closing the deal. There’s no way to tell,” said Giacalone in an exclusive interview with Wikinews.

In regards to the lawsuit, Giacalone thinks it may now be in “limbo.”

“The lawsuit still sits in limbo,” added Giacalone.

Fukushima reactor suffers multiple fires, radiation leak confirmed

Fires broke out at the Fukushima Daiichi plant’s No. 4 reactor in Japan on Tuesday, according to the Tokyo Electric Power Company. The first fire caused a leak of concentrated radioactive material, according to the Japanese prime minister, Naoto Kan.

The first fire broke out at 9:40 a.m. local time on Tuesday, and was thought to have been put out, but another fire was discovered early on Wednesday, believed to have started because the earlier one had not been fully extinguished.

In a televised statement, the prime minister told residents near the plant that “I sincerely ask all citizens within the 20 km distance from the reactor to leave this zone.” He went on to say that “[t]he radiation level has risen substantially. The risk that radiation will leak from now on has risen.”

Kan warned residents to remain indoors and to shut windows and doors to avoid radiation poisoning.

The French Embassy in Japan reports that the radiation will reach Tokyo in 10 hours, with current wind speeds.

Sean Penn endorses Kucinich for US President

Academy Award winning actor and political activist Sean Penn has just thrown his support in the 2008 US Presidential election behind Dennis Kucinich.

In a San Francisco speech described by his PR people as “a blistering indictment of political leaders and an impassioned endorsement of Presidential proportions,” Penn threw his support behind the lesser known Democratic candidate.

The Kucinich campaign did not vet the speech.

Dennis Kucinich, who with the minimal time allotted him, once again rose up beyond the sound bite and put principle ahead of party; argued policy rather than politeness. He has been the dominant voice of integrity on issues of trade, labor, education, environment, health, civil liberties, and the one endlessly determined voice of peace.

But is he too short? Does his haircut not appeal? Is he not loyal enough to a cowardly democratic platform? Does he not appeal to the cult of personality?

And what if the answer is yes?

What if Dennis Kucinich, the most deserving and noble of candidates, the most experienced in issues of policy and the least willing to play into the politics of personal power? What if we can’t elect a man simply on the basis of the best ideas, the most courage, and the most selfless service? What does it say about our country when we can’t rally the voices of the common good to support a man, like our troops, who would die for us, who would die for our constitution?

Penn first became politically active in October 2002, when he spent $56,000 on a full-page ad in the Washington Post, asking President George W. Bush to end “a cycle of violence”. He visited Iraq briefly in December of that year, Iran in 2005 as a journalist, and met with Venezuelan president Hugo Chávez for two hours in 2007.

Penn went to New Orleans to “aid rescue workers” after Hurricane Katrina; many questioned how much of a liability an untrained worker, especially when his boat sprang a leak, would be. One website commented “just showed up with his entourage and a personal photographer with the apparent intent of just wandering around looking for a good photo op.”

Pennsylvania cop on trial for allegedly murdering girlfriend’s estranged husband

The trial began today for a Pennsylvania state trooper accused of killing his girlfriend’s estranged husband.

Kevin Foley, 43, is accused of cutting the throat of John Yelenic, a dentist who was in the final stages of finalizing a divorce from his wife, Michele. According to prosecutors, Foley “loathed Dr. Yelenic” so much that he asked another fellow trooper to help him commit the alleged murder, which occurred in Yelenic’s Blairsville home.

Deputy Attorney General Anthony Krastek told an Indiana County jury that Foley also prayed Yelenic would die, and spread false rumors that Yelenic molested his adopted son.

“You will see Kevin Foley has the motive, the opportunity and the ability to commit this crime, almost to the exclusion of anybody else,” Krastek said.

Foley’s defense attorney, Jeffrey Monzo, said during opening statements that DNA evidence was not conclusive. Monzo admitted to the jury that Foley did not like Yelenic, but said that does not mean he murdered him.

“Kevin Foley is innocent,” he said.

Prosecutors said they could call as many as 70 witnesses to try and prove Foley wanted Yelenic to die. The trial, at the Indiana County Courthouse, is expected to last about three weeks.

Foley, who is on unpaid suspension from the Pennsylvania State Police, is charged with criminal homicide. The jury has the option of convicting him of first-degree murder, which could put Foley in prison for life without parole, or of a lesser degree charge, like manslaughter.

John Yelenic was found dead in his home on April 13, 2006, one day before he was planning on signing his divorce papers. Prosecutors said Foley killed Yelenic after going to the dentist’s house to confront him over the terms of the divorce. Prosecutors claim Foley slashed Yelenic several times with a knife and pushed his head through a small window, causing a further gash on his neck. Yelenic bled to death.

Foley had been living with Michele Yelenic for two years at the time of the alleged homicide. Krastek said Michele also helped perpetuate rumors that Dr. Yelenic molested their son. John and Michele Yelenic had been separated in 2002. Michele Yelenic stood to collect Dr. Yelenic’s estate and a $1 million life insurance policy, and could lose about $2,500 a month in support if the divorce was finalized, a Pennsylvania grand jury previously determined.

Michele Yelenic is expected to testify that Foley was home with her when the alleged murder occurred. Krastek told the jury DNA under Yelenic’s fingerprints will ultimately link him to the murder, as will bloody shoe prints found at the crime scene that match athletic shoes Foley is known to wear.

Monzo also said authorities have failed to investigate several other suspects, including Yelenic’s neighbor. Monzo said Yelenic was on very friendly terms with the neighbor’s wife, which could have given him a motive to commit the murder.

Prior to the trial, Foley’s defense attorneys unsuccessfully sought a change of venue because an overwhelming majority of the jury pool was familiar with the allegations. The change was denied when jurors insisted they had not formed an opinion about the charges.

California jury orders Skilled Healthcare to pay $671 million in damages

A California jury in a Humboldt County courthouse ordered nursing home operator Skilled Healthcare (SH) to pay $671 million (about €531 million) in a class action lawsuit from patients of SH’s 22 California facilities and their families. The jury found that SH failed to properly staff its facilities to comply with California state law.

The jury has not heard the case for punitive damages; however, it awarded the plaintiffs $613 million (about €484 million) in statutory damages. The remaining $58 million (about €46 million) was in restitution.

After the verdict was issued, Skilled Healthcare stocks plunged over 75% to a record low.

An official statement from SH says it “strongly disagrees” with the jury’s verdict. SH plans on filing an appeal to the decision. The company could possibly face bankruptcy because of this verdict.

One of the lawyers for the nearly 32,000 plaintiffs, Timothy Needham, claimed that inadequate staffing levels put SH’s patients at risk. He said, “The company knows that this lack of staffing causes a higher risk of problems for patients. Call lights don’t get answered, persons don’t get proper hygiene, persons don’t get their medications on time or the care they need.”

This lawsuit does not apply to SH’s facilities in Arizona, Iowa, Kansas, Missouri, Nevada, New Mexico, and Texas.

What Is A Membrane Roof?

A membrane roofing system is a popular choice for a commercial roof; it is designed to reduce the possibility of pooling and to reduce the incidence of leaks which are often associated with other roofing systems. This type of roof is rapidly becoming the favorite type of commercial roof, replacing the old traditional roofs that were used in the past. Membranes roofs are used on flat roofs or roofs which are only slightly sloped. The roofing system is available in three types; thermo-set, thermoplastic and modified bitumen.

A thermo-set roof consists of rubber sheets which are laid on the roof surface, the rubber sheets overlap at the edges. The overlapped seams are heated which causes the rubber to melt, resulting in the series of sheets to become one large continuous membrane. The rubber that is used in manufacturing the sheets is designed to form a chemical bond when heated; the seal becomes as strong as the sheet.

A commercial roof using a thermoplastic membrane is quite similar to a thermo-set roofing system but the material is PVC rather than rubber. The sheets of PVC do not form a chemical bond but they do form a tight seal when heated but the seal is effective on keeping out water. A thermoplastic membrane roof is somewhat less expensive than a thermo-set roof but it will need a little more maintenance.

Of the three systems, modified bitumen is the least expensive and the most common. The bitumen comprises rubber compounds and certain modifiers which are added to normal asphalt roofing compound. The modified bitumen is heated so that when it installed on the roof it forms a tight seal. There are new variation’s of this material; the new material does not need heat for application, it is produced in sheets in the factory; the sheets are lapped and held in place by self-adhesive strips, the seams, which overlap form a watertight seal.

A classic membrane roof system is prone to leaks because of the way it is constructed; this is not the case when a membrane is used as the commercial roof. In the case of traditional membrane roofs the seams are not sealed tightly, this is not the case with modern membrane roofs. Another advantage is that there is no need to place a gravel overlay which is normally the case with an asphalt roof. Because membrane roofing sheets are fastened directly to the roof, there is no need for gravel to hold them in place.

Comic Relief funds allegedly invested in arms, alcohol and tobacco firms

Major British charity Comic Relief has invested money in arms, alcohol and tobacco firms, according to a BBC Panorama investigation to be broadcast this evening.

The probe discovered evidence of hundreds of thousands of pounds going towards shares in weapons firms like BAE Systems and alcohol company Diageo. It is also alleged to have pledged upwards of £3 million into tobacco firms.

Ethical fund manager Helen Wildsmith told Panorama: “If people who’ve been giving them money, after watching the television, next year think twice and don’t give that money, because they’re concerned about their investment policy, then that could be argued to be a breach of fiduciary duty. They’re risking their reputation, and a charity’s reputation is very precious.”

Comic Relief was founded in 1985, and since then has taken in nearly £1 billion in donations. It funds charitable organisations in the United Kingdom as well as overseas. It uses a range of managed funds, which invests the money in the charity’s name – including on the stock market – in order to maximise return.

A spokesperson for the charity told the British newspaper The Daily Telegraph: “We put the money into large managed funds, as many other leading charities and pension funds do. On balance, we believe this is the approach that will deliver the greatest benefits to the most vulnerable people.”

The controversial investments were made between 2007 and 2009, Panorama explains. Peter Bennett-Jones, former chair of the company, defended the investments in a post on The Guardian’s website.

He said: “The Charity Commission guidance is quite clear that trustees must invest for the best possible financial return, while taking a level of risk appropriate for money in their care. They should only adopt an ethical investment approach with specific justification and not on the grounds of individual moral views. This sounds counterintuitive, but it is the law.”
