FDA says Coca-Cola’s Diet Coke Plus is misbranded

The US Food and Drug Administration has written a warning letter to The Coca-Cola Company that Diet Coke Plus violates the Federal Food, Drug, and Cosmetic Act‘s guidelines. The December 10 letter, signed by Roberta Wagner, director of the office of compliance at the Center of Food Safety and Applied Nutrition, says Coca-Cola should “take prompt action to correct these violations.”

The product’s label describes the drink as “Diet Coke with Vitamins and Minerals.” FDA said the soft drink does not have enough nutrients to justify the use of the word “plus” in its trade name. According to statute, foods must contain at least 10 per cent more of the Reference Daily Intake (RDI) or Daily Reference Value (DRV) for a given nutrient “than an appropriate reference food” in order to be called “plus” legally.

The FDA also advised “it is inappropriate to add extra nutrients to snack foods such as carbonated beverages.” The FDA warns Coca-Cola and asks it to revise the drink’s labeling and inform the agency of its reply regarding how it plans to fix the violation, within 15 days of receiving the warning. Coca-Cola says it will submit a reply to the FDA in early January, but currently has no plans to alter the label.

The US Federal Food, Drug, and Cosmetic Act (FFDCA, FDCA, or FD&C), is a set of laws passed by Congress in 1938 giving authority to the Food and Drug Administration (FDA) to oversee the safety of food, drugs, and cosmetics. A principal author of this law was Royal S. Copeland, a three-term U.S. Senator from New York, whose concerns about drug safety stemmed from the fact that he was also a homeopathic physician. The act has been amended many times, most recently to add requirements about bioterrorism preparations.

The Coca-Cola Company issued a statement saying, “This does not involve any health or safety issues, and we believe the label on Diet Coke Plus complies with FDA’s policies and regulations.”

Forbes has reported that “Coca-Cola has been on a crusade to revamp its image from a purveyor of highly sweetened, fattening products to a more family-friendly image of low-calorie, nutritional drinks. Its violation of the Federal Food, Drug and Cosmetic Act could mean hefty fines and a seizure of product from the pop king, but often these sorts of issues are resolved without incident.”

Moon water possibly originated from comets, data shows

Data from recent detailed analyses of samples collected on NASA Apollo moon missions, released Sunday, show that Lunar water may originate from comets that collided with the moon early in its geologic history.

A team of astrophysicists led by James Greenwood of Wesleyan University in Connecticut analyzed samples collected on the Apollo 11, 12, 14, and 17 missions and found that the chemical properties of traces of lunar water in these samples differ from water typical of Earth.

“The values of deuterium/hydrogen (D/H) that we measure in apatite in the Apollo rock samples”, Greenwood told Space.com, “is clearly distinguishable from water from the Earth, mitigating against this being some sort of contamination on Earth.” Greenwood and his team of researchers studied in particular the variations of hydrogen in the mineral apatite.

The newfound data show that the chemical properties of water in the apatite samples resemble data from the comets Hale-Bopp, Halley, and Hyakutake, suggesting that the water present on the moon could have originated from these comets or others.

According to Greenwood, the results of this study could also provide evidence as to the origin of water on Earth.

Higuaín leaves Napoli for Juventus

Yesterday, Italian football club Juventus F.C. announced signing of Argentine striker Gonzalo Higuaín from their rival club S.S.C. Napoli. 28-year-old Higuaín signed a five-year contract with the Old Lady for an Italian record transfer fee of €90 million.

Debuting at the age of 17 in 2005, Higuaín has made 329 league appearances and scored 191 goals. He joined Spanish capital club Real Madrid in 2006. Spending six-and-half seasons with Los Blancos, Higuaín has won the La Liga title there.

Higuaín — nicknamed Pipita — joined Napoli in 2013. While there he broke the goal scoring record set by Gunnar Nordahl of the Italian Serie A, netting 36 goals in 35 appearances. He helped Napoli qualify for the UEFA Champions League as the club finished second in the league.

In remarks to Gazetta World following Higuaín’s agreement to the contract, AS Roma captain Francesco Totti said, “Footballers today are a bit like nomads[…] They follow money and not their hearts.” 40-year-old Totti has played 25 years for Roma, signing a one-year contract extention last month.

Employment contracts are some of the most important UK business documents you will ever sign in your working life, and yet they are written in a deliberately convoluted and confusing manner, which often makes it difficult to get the clear points of what youre signing up for. Take your time, and read and re-read every contract, but pay special attention to the clauses, to ensure you understand them. Employers can put some unreasonable bits in here, so it pays to know what each one means. Here are some of the more common employment contract clauses so you know what to look for. And managers: if you want these points enforced, be sure to include them in your UK business documents!

Changes in Circumstances and Personal Information This common employment contract clause forces all employees to inform the employer when their personal circumstances change. This may be accompanied by a list of circumstances covered by the rule. Dress Code for Uniforms If employees are required to wear a uniform, this can be used to enforce how they should be worn. This can include stipulations regarding cleanliness and how they physically are to be worn though it has to be subject to religious or personal circumstances which can prevent employees from complying. Gardening Leave This employment contract clause means that employers can make employees who have handed in their notice, or been dismissed serve out the remainder of their time at home. They will be on full pay, but with the advantage to the company that they are held to the contractual agreements (e.g: confidentiality and exclusivity clauses still remain) and are available to be called back to work at short notice. This clause in a contract should then detail what action will be taken in instances where the rule is broken. Possibilities include re-deployment or firing of one of the employees. Restrictive Covenants There are a number of different restrictive covenants that can be enforced, and largely relate to restricting the employees competition to his/her employer when he/she leaves. This can include area-covenants, which prevent employees working for competitors, non-solicitation covenants which prevents the poaching of clients from the former employer and non-solicitation of staff covenants, which prevent the former employee dealing with his/her former fellow employees for a defined time after termination of employment. Restrictions on Outside Employment This is one of the more common employment contract clauses. It usually prevents employees taking on any additional work during their agreed hours of employment, and requires written permission from the employer for work outside the agreed hours. This is generally backed up by a note that permission will not be granted for work that competes with the employers business or that which will affect the employees work performance. Rights to Intellectual Property This contract clause can be used to ensure employees involved in creative production waive any right to intellectual property, and clarifies that the employer owns any copyright or other IP right. This can be open to interpretation, so should be accompanied by a definition of what the employer classes as intellectual property Use of Protective Clothing This wont apply to the majority of offices, but this contract clause is designed to ensure that protective clothing and equipment is worn to comply with health and safety regulations. This section may also outline the possible disciplinary action to be taken in the even of a breach. Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

Chelsea announces Nike sponsorship

Yesterday, English capital football club Chelsea FC announced a long-term deal with US sports company Nike.

Currently, German company Adidas made the kits for The Blues, a deal worth £30 million annually. Chelsea’s contract with Adidas runs till 2023. Chelsea is obliged to pay about £40 million to the German firm. Chelsea’s termination of Adidas’s contract was announced in May.

Per the contract with the US company, Chelsea would receive a reported sum of £60 million each year. Announcing a long term contract, Nike Brand president Trevor Edwards said, “The partnership with Chelsea reinforces our leadership position in football. We are excited to help grow the club’s global reach, serving players and supporters with Nike innovation and design.”

Chelsea director Marina Granovskaia, for the team’s part, said, “This is an incredibly exciting and important deal for the club.”

Chelsea won the Premier League in 2014–15 under Portuguese manager José Mourinho but they finished tenth last season.

Adidas and Spanish club Real Madrid signed a ten year contract earlier this year and the German sports brand sponsors other football giants like FC Bayern München, Juventus F.C., A.C. Milan, and Manchester United F.C.

Viktor Schreckengost dies at 101

Viktor Schreckengost, the father of industrial design and creator of the Jazz Bowl, an iconic piece of Jazz Age art designed for Eleanor Roosevelt during his association with Cowan Pottery died yesterday. He was 101.

Schreckengost was born on June 26, 1906 in Sebring, Ohio, United States.

Schreckengost’s peers included the far more famous designers Raymond Loewy and Norman Bel Geddes.

In 2000, the Cleveland Museum of Art curated the first ever retrospective of Schreckengost’s work. Stunning in scope, the exhibition included sculpture, pottery, dinnerware, drawings, and paintings.

Interview: Danny O’Brien of the Electronic Frontier Foundation

January’s second Interview of the Month was with Danny O’Brien of the Electronic Frontier Foundation (EFF) on 23 January in IRC.

The EFF is coming off a series of high-profile successes in their campaigns to educate the public, press, and policy makers regarding online rights in a digital world, and defending those rights in the legislature and the courtroom. Their settlement with Sony/BMG, the amazingly confused MGM v Grokster decision by the Supreme Court of the United States, and the disturbing cases surrounding Diebold have earned the advocacy organization considerable attention.

When asked if the EFF would be interested in a live interview in IRC by Wikinews, the answer was a nearly immediate yes, but just a little after Ricardo Lobo. With two such interesting interview candidates agreeing so quickly, it was hard to say no to either so schedules were juggled to have both. By chance, the timing worked out to have the EFF interview the day before the U.S. Senate schedule hearings concerning the Broadcast flag rule of the FCC, a form of digital rights management which the recording and movie industries have been lobbying hard for – and the EFF has been lobbying hard to prevent.
